Terms of Service

These Terms of Service ("Terms") govern your access to and use of Censable (the "Service"), a demographic analysis platform operated by Smart Real Estate Data ("we," "us," or "our"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Account creation and sign-in are handled through our authentication provider, Base44. By registering, you authorize us and Base44 to create and manage your login credentials. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. You must provide accurate information and promptly update it if it changes.

You must be at least 18 years old and able to form a binding contract to use the Service.

The Service offers a free Starter plan and paid subscription plans (Professional and Elite), as well as optional one-time credit packs. Paid plans renew automatically each billing period until canceled. Each report generated consumes one credit.

Payments are processed by Stripe. By subscribing or purchasing credits, you authorize recurring or one-time charges to your payment method. You may cancel a subscription at any time from your profile; cancellation takes effect at the end of the current billing period, and you retain access and remaining monthly credits until then. Except where required by law, payments are non-refundable, and unused monthly credits do not roll over.

You agree not to:

• Resell, sublicense, or redistribute reports or data except as permitted by your plan;
• Reverse engineer, scrape, or attempt to bypass usage limits or credit metering;
• Use the Service to violate any law or infringe the rights of others;
• Interfere with or disrupt the integrity or performance of the Service.

Demographic data is derived from public sources including the U.S. Census Bureau (ACS and Decennial), TIGERweb, and other third-party providers. While we strive for accuracy, the data is provided "as is." We do not warrant that reports are error-free or suitable for any particular decision. Reports are informational tools and should not be the sole basis for financial, investment, lending, or real estate decisions.

The Service, including its software, design, and branding, is owned by Smart Real Estate Data and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes. Reports you generate may be used for your own and your clients' purposes consistent with these Terms.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMART REAL ESTATE DATA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

We may suspend or terminate your access to the Service at any time for violation of these Terms. You may stop using the Service and cancel your subscription at any time. Provisions that by their nature should survive termination will survive.

We may update these Terms from time to time. Material changes will be reflected by updating the effective date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
